Are there grandparent rights in Florida?

Grandparent in Florida only have a legal right to visit with their grandchildren under very, very limited circumstances.

Michelle: Hi. My question is, is there such a thing as grandparents' rights in the state of Florida?

Attorney Tom Olsen: Well, we talked about that earlier and the answer is, on a very limited situation. There's a relatively new law out there that says that the only time grandparents will have a legal right to visit with their grandkids are if both mom and dad are dead, legally incarcerated for a felony, or mentally incompetent-- Sorry, incapacitated you might say. That's got to be a tiny percentage of people that fit that fact situation. In fact, that would be the only time you could get some legal rights by going to court and having a court order, Michelle.
